About Sustainable Summer Sustainable Summer is the trade name of Sustainable Learning, Inc., a non-profit incorporated in the State of New York for the purpose of facilitating experiential and theoretical learning on the subject of environmental sustainability (hereafter “SUSTAINABLE SUMMER”).
Participant Eligibility An application for admissions is open to students meeting the age and grade restrictions specified for each program offered by SUSTAINABLE SUMMER. Admission decisions are based solely at the discretion of SUSTAINABLE SUMMER. Admitted students are invited to enroll in a program session as specified in an acceptance email and will include an enrollment deadline and a requirement that a parent or legal guardian agree to and digitally sign our terms of enrollment.
Program Dates The first date of a session is the day students arrive. The last date of a session is the day students depart. Students are expected to participate in the entire program. Late arrival and early departure is not permitted except for emergencies or if Sustainable Summer, at its sole discretion, removes a student based on reasons outlines in our Conditions of Participation.
Tuition and Payment Information A deposit of $750 (hereafter “DEPOSIT”) is necessary to secure enrollment in THE PROGRAM. This DEPOSIT is applied against THE PROGRAM tuition as specified by my selections while completing this enrollment form and in the confirmation email (hereafter “TUITION”), but is in addition to any previously paid non-refundable application fee that is not credited towards TUITION. Payments in addition to the DEPOSIT must be made by check, e-check, money order or bank transfer. Payments by credit card or wire transfer carry additional fees, which are the responsibility of the payer, as are any fees Sustainable Learning incurs for a bounced check.
TUITION does not include travel to THE PROGRAM, most notably the cost of any airfare required to attend THE PROGRAM.
The balance of TUITION less DEPOSIT is due within 30 days and/or at least 21 days prior to the program start date.
Full payment must be received by the payment due date, or PARTICIPANT must be enrolled in a payment plan, to guarantee enrollment status. Invoices more than 7 days overdue will be considered delinquent accounts and in no case will a PARTICIPANT be permitted to begin a program unless full payment has been received. SUSTAINABLE SUMMER reserves the right to cancel the participation of any PARTICIPANT associated with a delinquent account. Cancelled memberships will be subject to the terms described in the “refund policy” section below.
SUSTAINABLE SUMMER reserves the right to collect unpaid delinquent account balances, including a late payment fee of 1.5% per month of the invoice value or the maximum amount allowable by law, on delinquent accounts. Fees may be charged to the credit card provided during enrollment.
All schedules and fees quoted are based on current tariffs, fuel/energy costs, costs of operations and currency rates as of the date of this agreement and are subject to confirmation or adjustment should there be any revision in such tariff rates and/or costs before THE PROGRAM due to global economic shifts in exchange rates, fuel prices, or other price increases associated with our costs.
Cancellation and Refund Policy All cancellations or notifications of change in enrollment must be in writing.
Cancellation of Program:
Prior to April 1st
All tuition payments less the initial $750 enrollment deposit are fully refundable prior to April 1st. Alternatively, deferring enrollment to a Sustainable Summer program in the next calendar year is allowed without penalty by rolling over the enrollment deposit.
Between April 1st and April 31st
50% of tuition will be refunded for notice of cancellation prior to May 1st. Alternatively, enrollment can be deferred to a Sustainable Summer program in the next calendar year by rolling over the full amount of tuition paid without penalty.
May 1st and later
There are no refunds for cancellations received on or after May 1st. We will consider requests to defer enrollment to next year or change to a different program or session in the current year at our sole discretion and without obligation.
If enrolled in multiple Sustainable Summer programs, canceling enrollment in a program while still maintaining an active enrollment status in at least one program is considered a “Change of Program” and is subject to the same terms as described below.
Change of Program:
If you would like to change to a different SUSTAINABLE SUMMER program, for any reason, you can do so without penalty prior to May 1st, subject to availability. We cannot guarantee availability in any one particular program other than the one the student is accepted into and we will not under any circumstances issue a refund if we are unable to accommodate a request other than as specified in the cancellation and refund schedule stated elsewhere in this enrollment form. On or after May 1st, change of program is not allowed and there are no tuition refunds.
Deferred Enrollment:
Deferring enrollment to any SUSTAINABLE SUMMER program in the next calendar year is allowed based on the following schedule:
Prior to April 1st
Enrollment can be deferred to a Sustainable Summer program in the next calendar year by rolling over the initial enrollment deposit.
Between April 1st and April 31st
Enrollment can be deferred to a Sustainable Summer program in the next calendar year by rolling over the full amount of tuition paid.
On or after May 1st
Deferred enrollment is not allowed and there are no tuition refunds. We will consider extenuating circumstances at our sole discretion and without obligation.
NOTE: Tuition rates for future programs may increase and you are not grandfathered into a rate. Any tuition previously paid will post as a credit to your account. We are only able to offer the deferred enrollment option for one year and only to the participant or a participant’s sibling. The refund and cancellation policies in place at the time of your deferment will apply for one year. After one year, the current refund and cancellation policies will apply.
Conditions of Participation I authorize the participation of PARTICIPANT in THE PROGRAM. SUSTAINABLE SUMMER reserves the right in its sole discretion to terminate the participation of any participant who does not abide by the procedures, policies and rules and regulations, and/or whose conduct is deemed by the directors to be such as to endanger the participant, the success of THE PROGRAM, or the welfare of other participants and/or the directors or staff members. In the event of such termination, the parent or guardian will be notified, PARTICIPANT will be sent home at the earliest possible time and there will be no refund whatsoever.
The manner and means of transporting PARTICIPANT home shall be determined exclusively by SUSTAINABLE SUMMER and all additional expenses incidental to the termination, including the entire cost of the transportation of the PARTICIPANT back home, including, if applicable, the purchase of a new one-way airline ticket, shall be borne completely by the parent/guardian or PARTICIPANT. I agree that if PARTICIPANT is sent home for any reason there will be a parent/guardian to meet and pick up the PARTICIPANT at the airport from the flight SUSTAINABLE SUMMER chooses. I agree that if the parent/guardian is not home and traveling, that there will be a relative or emergency contact adult (over 21 years old) designated to pick up PARTICIPANT from the airport from the flight that SUSTAINABLE SUMMER chooses home.
I agree to provide SUSTAINABLE SUMMER with all information regarding my PARTICIPANT that may be relevant to his/her emotional and physical well-being while attending THE PROGRAM. I understand that failure to inform SUSTAINABLE SUMMER in writing of any important medical information, including, but not limited to, my PARTICIPANT receiving professional counseling, or prior/current use of any behavior modification medication in the previous 24 months, may lead to dismissal of my PARTICIPANT from THE PROGRAM. In the event of such termination, the PARTICIPANT will be sent home. The manner and means of transporting the PARTICIPANT home shall be as described in the above paragraph. In the event of such termination, there will be no refund whatsoever.
I understand that I will be required to sign and comply with various written waivers and liability releases prior to the beginning of THE PROGRAM. PARTICIPANT will not be permitted to participate in THE PROGRAM unless all required paperwork has been received at SUSTAINABLE SUMMER’s office in New York at least 30 days prior to the commencement of THE PROGRAM.
Additional Conditions of Participation for Programs Outside the United States I understand that PARTICIPANT requires a valid passport for SUSTAINABLE SUMMER international programs. Participants traveling on a United States passport will be notified of any visa requirements. Participants from outside the United States will be responsible for ascertaining visa requirements and obtaining the necessary visas for their countries of travel, if any.
I understand that SUSTAINABLE SUMMER will provide information about purchasing airfare on a group flight for all participants originating travel from the United States. In the event that I choose not to have my PARTICIPANT travel on a designated group flight, I understand that SUSTAINABLE SUMMER will bill me for the costs associated with coordinating airport transfers and I understand that my alternative itinerary must be pre-approved by SUSTAINABLE SUMMER due to logistical and safety considerations.
I understand that PARTICIPANT will be traveling to a foreign country and will at times be in remote areas and participate in other potentially dangerous activities.
Additional Conditions of Participation for Programs Inside the United States I understand that I am responsible for transporting PARTICIPANT to THE PROGRAM on the start date of THE PROGRAM by my own means and that SUSTAINABLE SUMMER holds no responsibility towards PARTICIPANT until he or she has arrived at the designated check-in point for THE PROGRAM during the arrival times designated by SUSTAINABLE SUMMER. I similarly understand that on the final date of THE PROGRAM, I am responsible for PARTICIPANT’s departure from THE PROGRAM and that SUSTAINABLE SUMMER holds no responsibility towards PARTICIPANT after he or she has departed the designated check-out point.
Responsibility Clause SUSTAINABLE SUMMER, its employees, members, subsidiaries, affiliates, officers, directors, successors, agents, and assigns (collectively SUSTAINABLE SUMMER) does not own or operate any entity which is, to, or does provide goods or services for your trip including, for example, lodging facilities, transportation companies, food service providers, etc. As a result, SUSTAINABLE SUMMER is not liable for any negligent or willful act or failure to act of any such person, or of any third party not under its control. Without limiting the foregoing in any manner, SUSTAINABLE SUMMER accepts no responsibility for any risks or resulting injury, delay, inconvenience, damages, or death which results from criminal activity, weather or other acts of God, accidents, illness, the demands of outdoor activities, strikes, political unrest, acts of terrorism or any other events beyond its direct control. Participants and parents/guardian agree to recognize and assume these risks. I hereby give permission for PARTICIPANT to participate in all travel excursions and take part in all activities scheduled by the directors of SUSTAINABLE SUMMER. I have read this SUSTAINABLE SUMMER enrollment form carefully, and I willingly agree to comply with all of the various requirements and conditions spelled out in these materials. I understand that there are risks associated with participation. I further acknowledge that it is PARTICIPANT’s responsibility to abide by the rules, conditions and instructions provided by SUSTAINABLE SUMMER to minimize the risk of injury, accident, damage, or death. My signature indicates that I give my specific consent to PARTICIPANT’s participation in all program activities and use of necessary equipment for those activities including, but not limited to: biking, rollerblading, ropes course, rock climbing and climbing walls, hiking, backpacking, camping, swimming, snorkeling, rafting, kayaking, canoeing, sailing, surfing, bodyboarding, windsurfing, and other similar activities, and to travel in public transportation and privately leased or hired vehicles.
Medical Treatment Consent I hereby grant SUSTAINABLE SUMMER full authority to take whatever actions it may consider to be warranted under the circumstances regarding my child’s health and safety, and I fully release SUSTAINABLE SUMMER from any liability for such circumstances or actions as may be taken in connection therewith. I authorize SUSTAINABLE SUMMER, at its discretion, to place my child, at my own expense and without any further consent, in a hospital for medical services and treatment or, if no hospital is readily available, to place my child in the hands of a licensed medical doctor for treatment.
I understand that PARTICIPANT must be covered by primary medical insurance. SUSTAINABLE SUMMER cannot assume any medical costs incurred during THE PROGRAM.
I understand that PARTICIPANT shall not begin or discontinue use of a behavior modification medication less than 30 days prior to THE PROGRAM, and that doing so will be considered a violation of these terms of enrollment and PARTICIPANT’s participation in THE PROGRAM will be terminated.
I understand that I am financially responsible for any out-of-pocket costs associated with PARTICIPANT’s participation in THE PROGRAM, including, but not limited to, damage to property, a visit to a health clinic, an oversize bag fee and similar costs paid by SUSTAINABLE SUMMER on behalf of PARTICIPANT in excess of the participation costs included in TUITION.
Privacy Disclosures I permit SUSTAINABLE SUMMER to share PARTICIPANT’s enrollment status, including travel details and contact information, solely with other program participants. I permit SUSTAINABLE SUMMER to contact PARTICIPANT’s school or guidance counselor to inform them of PARTICIPANT’s participation on a SUSTAINABLE SUMMER program. I authorize SUSTAINABLE SUMMER to take and use photographs, videotapes and testimonials of PARTICIPANT for use in publicity materials or program information.
Indemnification I, the undersigned, am a legal guardian of PARTICIPANT. I agree to defend, indemnify, and hold harmless SUSTAINABLE SUMMER from and against any and all claims, suits, liens, judgments, damages, losses and expenses including reasonable legal fees and costs arising in whole or in part and in any manner in connection with this agreement from any other legal guardian of PARTICIPANT, from PARTICIPANT himself, and/or any other entity acting on the behalf of PARTICIPANT that is not an undersigned party to this agreement. In the event of my incapacity or death, this agreement binds my heirs, executors, administrators, and representatives.
Force Majeure I agree that in the event of any failure or delay by SUSTAINABLE SUMMER under this agreement resulting from causes beyond SUSTAINABLE SUMMER’s reasonable control and occurring without its fault or negligence, including without limitation fire, acts of God, war, governmental action, act of terrorism, epidemic, pandemic, or any other similar event, SUSTAINABLE SUMMER shall not be liable for any such failure or delay in its performance. If such an event occurs, I understand that PROGRAM may be postponed, extended, rescheduled, or cancelled at SUSTAINABLE SUMMER’s sole discretion.
In the event SUSTAINABLE SUMMER is unable to run a session then families will be refunded their full tuition. If a session is cancelled mid-program, the amount refunded will be prorated based on the number of days remaining in the session.
Sustainable Summer will not be responsible for non-program costs (such as airfare) associated with cancellation.
Additional Disclosures SUSTAINABLE SUMMER reserves the right to make any alterations in the program, accommodations, dates, transportation, food arrangements, activities, sight-seeing, program leadership and makeup of program membership as they, in their sole discretion, may deem necessary or desirable. SUSTAINABLE SUMMER reserves the right to limit enrollment and/or cancel any participant’s membership due to overwhelming or insufficient enrollment.
This agreement represents the full and complete agreement between SUSTAINABLE SUMMER and the undersigned regarding enrollment in the PROGRAM. This agreement supersedes all prior negotiations, agreements, terms, conditions, statements, or representations, whether written or oral, concerning the subject matter of this agreement. This agreement may not be altered, amended, modified or otherwise changed except in writing, and signed by both parties. Invalidity or unenforceability of one or more provisions of this agreement shall not affect any other provision of this agreement and the remainder of this agreement shall remain in full force and effect. Failure of either party to enforce any provision of this agreement does not prevent the party from enforcing any other provision of this agreement.
Any dispute concerning this agreement, the program, or any advertising materials concerning the program itself, will be resolved exclusively by arbitration in New York’s Kings County, pursuant to the then current rules of the American Arbitration Association. New York substantive law will apply to all issues concerning any such dispute.
